Tamil Nadu Chief Minister M.K. Stalin stated that the Hon’ble Supreme Court of India has stayed several key provisions of the BJP-led government’s amendments to the Waqf Act.
In a message shared via social media, he said the stay includes the mandatory 5-year practice requirement before dedicating a Waqf, powers to divest Waqf properties on mere allegations, and the authority of Collectors to denotify ‘Waqf by user’. The Court also stayed the inclusion of non-Muslim members exceeding the prescribed limit in the Central and State Waqf Boards.
He emphasized that this judicial order marks a significant victory against what he termed “unconstitutional and illegal” amendments, reaffirming the DMK’s long-standing opposition since the bill’s introduction. Stalin further noted that the DMK had also challenged the Act in the Supreme Court and passed a resolution in the Tamil Nadu Assembly urging its withdrawal.
He expressed confidence that the verdict would strengthen public trust in the judiciary’s role in safeguarding the religious rights of minorities and upholding constitutional values.
